What this agreement actually requires of you
Every website has Terms of Service and almost no one reads them. Cannabis-adjacent websites face a particular version of this problem: the legal stakes for both publisher and reader are unusually high, and a one-line "by using this site, you agree" buried at the bottom of a footer is genuinely insufficient. This preamble exists to make sure that anyone using FloridaMJ understands the actual obligations the agreement creates, in plain language, before they get to the binding legal text below.
The summary version: you must be 21 or older to use the site. You must verify any fact before relying on it. You may not use the site to do anything illegal. You may not scrape it, copy its data wholesale, or use its contents to train AI models. Reviews and submissions you post become subject to our editorial discretion. We disclaim warranties to the extent permitted by Florida law and limit our liability to what Florida law allows. Disputes are governed by Florida law and resolved in Florida courts. None of this is unusual for a publisher, but the preamble below explains why each piece exists.
Why we require age 21+
Florida's hemp-derived intoxicating cannabinoid retail framework, tightened by SB 1676, restricts access to age 21+ environments[5]. Most of the directory describes regulated cannabis products and licensed retail venues for which adult access is the operating norm. We accordingly set 21 as the floor for general use of the site. The narrow exception is Florida MMUR patients, whose access to the medical program may begin earlier under the qualifying conditions and caregiver framework set out in § 381.986[1]; nothing in these Terms restricts an MMUR patient's access to medical-program content.
Why we require independent verification
FloridaMJ's Compliance Desk re-pulls state license registries on a recurring schedule[3][4], but a directory page can be wrong on any given day for reasons outside our control. A dispensary's hours change. A license is suspended. A storefront closes. These changes do not always reach the public registry the same day they take effect. The Terms accordingly require every reader to independently verify any fact before relying on it — to call the dispensary before driving across town, to check the OMMU registry before assuming a license is current, to confirm hemp permit status with FDACS[5] before transacting. The verification obligation is the practical counterpart to the limitation-of-liability clause: we publish in good faith; you verify before you act.
Why we prohibit scraping and AI-training use
The directory exists because the Compliance Desk does the work of cross-referencing state registries against operator marketing, deduplicating entries, classifying retail categories, and verifying ownership chains. That research has economic value. The Terms accordingly prohibit automated bulk extraction (scraping, crawling, harvesting) without a written license, and they prohibit the use of FloridaMJ content to train commercial AI models without a prior written agreement. Short editorial quotation under 200 words with attribution and a link back is fine; mass duplication for resale or model training is not.
Why we structure the no-facilitation language so strictly
Cannabis remains a Schedule I substance under federal law[2]. A publisher that crosses the line from describing licensed retailers to facilitating sales — taking orders, processing payments, arranging deliveries — exposes itself to federal liability that no state-level license can cure. FloridaMJ never crosses that line. The Terms include explicit no-facilitation language not because we expect to be tempted but because the language must exist on the public record so that any future question about our role is answered by reference to a published commitment.
Why limitation of liability matters here
The Limitation of Liability section is in capital letters because Florida law (and the law of most states) requires conspicuous formatting for clauses limiting warranty or remedies. The substance is straightforward: we publish editorial content in good faith and to the best of our research ability, but we cannot warrant that every fact remains current at every moment, and we cannot be held responsible for the downstream consequences of a reader's individual decisions. This is the standard publisher-liability allocation, not a unique disclaimer, and it is the legal precondition for being able to publish a directory of regulated businesses at all.
Why governing law is Florida
FloridaMJ's editorial focus is exclusively the State of Florida. Our directory, statute summaries[1][6], qualifying-condition guides, and operator profiles all describe a Florida regulatory environment. Florida law accordingly governs the Terms and Florida courts are the exclusive forum for disputes. Out-of-state readers can still use the site freely, but any legal disagreement about how the site is used or what it contains is resolved under Florida law, not the law of the reader's home state.
